Instrument Rental Agreement

PURCHASE:
|
Purchase a new instrument of similar quality and value and apply all fees up to 12 months.
No rent fees will apply beyond ____________
. Rent fees are applied to the Manufacturer's Suggested Retail Price of $_______
only and may not be used in conjunction with other sale specials.
Rental instruments are NOT available for purchase except for percussion which are rent to own.

RENT PAYMENTS WHICH ARE PAST DUE BY TEN(10) DAYS OR MORE SHALL NOT BE CREDITED TOWARD THE PURCHASE PRICE.
|
|
TERMS:
|
The terms of this rent shall be from month to month and shall be automatically renewed each month until terminated by either
party upon 7 days notice.
DELINQUENCY CHARGE:
The lesser amount of
$10.00 or 5%
of unpaid amount not received on or before the 10th day after its due date. If you present us with a check that is returned for non-sufficient funds (NSF), or because you do not have an account at the financial institution on which the check was drawn, or because the account on which the check was drawn is closed, we will have the right to assess, and you may be required to pay, a charge not to exceed $15.00 for each such check.

REPAIRS:
|
Instrumental Music Company, Inc. agrees to maintain this rented instrument in satisfactory playing condition and to repair any physical
damage according to the terms of the maintenance and repair plan.
THERE IS NO ADDITIONAL CHARGE FOR THIS COVERAGE.

|
RETURN:
|
To avoid further monthly rent payments, customer
must notify INSTRUMENTAL MUSIC COMPANY, INC.
of the termination of the rent and permit them to take possession of the instrument prior to the expiration date.
|
|
|
In the event this instrument is not returned as required or is damaged beyond repair, the undersigned agrees to pay a sum equal to 70% of the published list
price of the instrument, regardless of the age or previous condition of the rented instrument. In all cases, the decision of
INSTRUMENTAL MUSIC COMPANY, INC. shall be final.

DEFAULT:
|
Upon default by renter, INSTRUMENTAL MUSIC COMPANY, INC. shall be entitled immediately to recover possession
of the instrument and customer shall pay INSTRUMENTAL MUSIC COMPANY, INC. costs, including statutory attorney's fees incurred in enforcing its rights hereunder.

|
If the undersigned moves from the address shown, INSTRUMENTAL MUSIC COMPANY, INC. will be advised promptly and shall have the option to cancel this agreement.
|
|
INDEMNITY:
|
Renter agrees to indemnify and hold Instrumental Music Company, Inc. harmless from any and all costs, expenses and liabilities which may arise from the proper or improper use of the instrument.
|
|
CREDIT CHECK:
|
We will have the right to conduct an investigation into your credit rating, including obtaining a report from a credit reporting agency. You will provide us with your full legal name, current address, social security number, current employer, and if you are married, the same information for your spouse. If we are not satisfied with the results of that report, we will have no obligation to rent the instrument to you. We will advise you in writing if the results of the credit investigation are not satisfactory to us. If we do not advise you in writing within seven days the rental will commence.

NOTICE OF CUSTOMER'S RIGHT TO CANCEL:
|
If you signed this Agreement at any place other than our business premises at 2908 Ontario Road, Green Bay, Wisconsin, you may cancel this agreement by mailing a written notice to Instrumental Music Company, Inc., 2908 Ontario Road, Green Bay, Wisconsin 54311-4966 before midnight of the third business day after you signed this agreement. If you wish, you may use this page as that notice by writing "I hereby cancel" and adding your name and address. A duplicate of this page is provided by Instrumental Music Company, Inc. for your records.

REMEDIES UPON DEFAULT:
|
If you do not abide by the terms of this Agreement, in addition to our right to terminate this Agreement upon seven days notice, we may terminate the agreement if we send you a notice telling why you are in default, what you have to do to cure the default and you do not cure the default within 15 days. We will have the right to sue to repossess the Instrument and to sue for any money you owe us, and such claims may be brought in one lawsuit and may be pursued simultaneously. You will pay our court costs and our statutory attorney fees if we prevail in such a lawsuit.

CUSTOMER ACKNOWLEDGES RECEIPT OF THIS STATEMENT AND DELIVERY OF THE INSTRUMENT FOR CUSTOMER'S USE AS OUTLINED ABOVE SHALL CONSTITUTE CUSTOMER'S ACCEPTANCE OF THIS AGREEMENT.

Your teacher suggests the following items in addition to your instrument. Check the items you want to purchase. They will be delivered with your instrument.
Step 5 - Enter your Payment Information for the Rental payments and select your payment plan.

What's included with your IMC rental fee
REPAIRS
Damage to the instrument will be repaired at no cost. In the event of total destruction of the instrument
or loss due to fire or theft, the renter is responsible for 70% of the retail value.
Instrumental Music Company will accept this total, less the deductible portion of the renter's home owner's insurance, as payment in full.
The renter must present proof of insurance and report any theft to police and Instrumental Music Company within 24 hours of incident.
MAINTENANCE
All adjustments and repairs will be made to keep the instrument in proper playing condition. This does not include restoration of finish nor replacment of any expendable items
such as reeds, lubricants, and drum sticks. Replacement of one mouthpiece will be made at no charge upon exchange of a broken one.
Instrumental Music Company, Inc. will not reimburse renter for repairs performed on rental instruments by any third party.
